Terms of Service

Please read these Terms of Service (“Terms”) carefully before using ShoutThisOut (“we,” “us,” “our”). By creating an account or placing an order you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Acceptance of Terms

By accessing or using ShoutThisOut you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you have the legal capacity to enter into a binding agreement. If you are using ShoutThisOut on behalf of a business, you represent that you have authority to bind that business.

2. The Platform

ShoutThisOut is an online marketplace that connects brands and individuals (“Buyers”) with content creators (“Creators”) for the purpose of commissioning sponsored content, shoutouts, video mentions, phone calls, and similar services (“Creator Services”).

ShoutThisOut acts solely as a marketplace intermediary. We do not create content, employ Creators, or guarantee any specific outcome from a booking. Contracts for Creator Services are formed directly between Buyers and Creators.

You must create an account to use most features of ShoutThisOut. You agree to:

You are responsible for all activity that occurs under your account. ShoutThisOut reserves the right to suspend or terminate accounts that violate these Terms.

4. Creator Obligations

Creators must apply and be approved before offering services. By applying, Creators represent that:

Selling fake engagement, using automation tools, or misrepresenting statistics will result in immediate account termination and forfeiture of any held funds.

6. Payments & Escrow

All payments are processed by Stripe, Inc. By making a payment you agree to Stripe’s Terms of Service.

When a booking is confirmed, the full amount (base price plus platform fee) is charged to the Buyer’s payment method and held in escrow by ShoutThisOut. Funds are only released to the Creator once:

Buyers must not initiate chargebacks through their bank or card issuer while a dispute is being processed through ShoutThisOut. Fraudulent chargebacks may result in account termination and recovery action.

7. Platform Fees

ShoutThisOut charges a platform service fee on each transaction, added to the Buyer’s checkout total. Creators receive their listed price in full; the platform fee is borne by the Buyer. Current fee rates are displayed at checkout and on the Pricing page.

ShoutThisOut reserves the right to change its fee structure with 14 days’ notice. Bookings already placed and paid will not be affected by fee changes.

8. Refunds & Disputes

Buyer-initiated refund: If a Creator fails to deliver by the agreed deadline, the Buyer is entitled to a full refund of the amount paid (including platform fee).

Disputes: If there is a disagreement about whether delivery was completed satisfactorily, either party may contact support@shoutthisout.com. ShoutThisOut will review the evidence and make a final, binding determination within 5 business days.

No refunds after approval: Once a Buyer has approved a delivery and funds have been released, no refunds are available unless ShoutThisOut determines at its sole discretion that fraud occurred.

9. Content & Intellectual Property

Creators retain ownership of the content they create. By delivering content through ShoutThisOut, the Creator grants the Buyer a non-exclusive, worldwide, royalty-free licence to use the delivered content for the purposes specified in the booking brief.

You may not use ShoutThisOut’s name, logo, or branding without prior written consent.

ShoutThisOut is provided “as is” without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that any particular result will be achieved from Creator Services.

To the maximum extent permitted by law, ShoutThisOut’s total liability to you for any claims arising from your use of the platform shall not exceed the total fees paid by you to ShoutThisOut in the 12 months preceding the claim.

ShoutThisOut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

12. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, pose a risk to other users, or if required by law. You may close your account at any time by contacting support@shoutthisout.com.

Upon termination, any outstanding bookings will be handled in accordance with these Terms (completed if possible, refunded if not). Sections 9, 10, 11, and 14 survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email and by updating the “Last Updated” date above. Continued use of the platform after the effective date of changes constitutes acceptance of the revised Terms.
